Terms of Service

1. Acceptance of Terms

By accessing or using Cribster Powered by KW Westfield (the “Service”), operated by Old Forrest Consulting, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

The Service provides access to real estate listing information sourced from Multiple Listing Service (MLS) databases. Listings, photos, and related data are displayed for informational purposes to help consumers search for properties.

3. MLS Data Usage Restrictions

All MLS listing data displayed on the Service is intended for personal, non-commercial use only. You may not:

  • Copy, redistribute, or republish any MLS listing data or photographs without prior written consent
  • Use listing data for any commercial purpose, including but not limited to resale, licensing, or data aggregation
  • Scrape, harvest, or systematically collect listing data through automated means
  • Use listing information to contact property owners for solicitation purposes unrelated to a bona fide real estate transaction

3a. MLS Data Terms

The listing data displayed on this Service is provided by UtahRealEstate.com. By using this Service, you acknowledge and agree to the following:

  • IDX information is provided exclusively for consumers' personal, non-commercial use
  • Information may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing
  • Data is deemed reliable but is not guaranteed accurate by UtahRealEstate.com or the MLS
  • You will not copy, redistribute, or retransmit any listing information except in connection with your consideration of the purchase of a property
  • You acknowledge UtahRealEstate.com's ownership of, and the validity of its copyright in, the MLS Compilation

4. No Guarantee of Accuracy

While we strive to display accurate and current listing information, the Service does not guarantee the accuracy, completeness, or timeliness of any data displayed. Listing information is provided by third-party sources including MLS databases, and may contain errors or become outdated. You should independently verify all information before making any real estate decisions.

5. Intellectual Property

All MLS listing data, including photographs, descriptions, and related content, is owned by the respective MLS and its participating brokers. The Cribster name, logos, and Service design are the property of Old Forrest Consulting. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

6. Account Terms

To access certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Providing accurate and current information during registration
  • Notifying us promptly of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to any part of the Service
  • Transmit any malicious code, viruses, or harmful content

8. Limitation of Liability

To the fullest extent permitted by law, Old Forrest Consulting and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages resulting from reliance on listing information, loss of data, or service interruptions. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
